I've seen it in actual books - I think my first encounter with it was in Steven Brust's The Phoenix Guards. I agree that it sounds like it shouldn't be.
My sister was reading me excerpts from a very caustic opinion which she found funny; I don't know the name of the case. The issue at hand was expert testimony, and the judge was expressing his displeasure with a Supreme Court opinion setting out what he felt to be inappropriate guidelines for dealing with it.
